Polanco V Sección, Ciudad de México, C.P. 11560, phone +52 55 52814065, in compliance with the provisions of Articles 1, 2, 6, 14, 15, 16, and other related and relevant provisions of the “Ley Federal de Protección de Datos Personales en Posesión de los Particulares”, as well as Articles 24, 25, 26, 27, 28 of its Regulations, is the DATA CONTROLLER for collecting, using and protecting your personal data.

Personal data subject to processing.

We hereby inform you that in order to fulfill the purposes set forth in this Aviso de Privacidad, ESPIÑEIRA & BÁEZ ARQUITECTOS, S.A. DE C.V. may collect Personal Data, either directly (when you visit our facilities), electronically (when you provide your contact information on our website and/or to follow up on the projects or construction sites we manage via email) or by phone, requesting the following information: Full name, email address, mailing address, phone numbers, tax identification number (RFC) (for billing purposes), location of the construction site and, if necessary, the public deed for you property (to process building permits).

The personal data you provide, including both general personal data and SENSITIVE financial data, will be maintained and processed with strict security and confidentiality for purposes related to our architectural design, construction, interior design, decoration and remodeling work and in accordance with this Privacy Notice, as well as applicable laws, regulations, guidelines and rules.

Purposes of Processing.

The data you provide to us Will be uses for the following purposes:

1. To fulfill the legal relationship established between ESPIÑEIRA & BÁEZ ARQUITECTOS, S.A. DE C.V., and you (the client), for the performance of architectural design, construction, interior design, decoration or remodeling of properties.
2. To prepare estimates and contracts for the provision of services or construction management.
3. To monitor the projects and construction work we carry out.
4. To handle the procedures for obtaining building permits or any other administrative requirements necessary to manage the construction projects.
5. Execution of work and service contracts with our contractors and/or purchase-sale contracts with material suppliers.
6. Administrative integration and updating of the Programa de Gastos de Obra de clientes.
7. Monitoring and Support of collection activities, billing, payment, and deposit required for the execution and management of construction projects.
8. Follow up on and respond any request you may have regarding your ARCO rights.
9. To provide you with personalized assistance, whether in person, by phone or electronically, regarding our services.
10. Monitoring access to our facilities.
    
    

Furthermore, if you provide your personal data (through our website) and later wish for us to stop using it, you must submit a request to that effect addressed to ARQ. JUAN JOSÉ ESPIÑEIRA CORTIZAS (Personal Data Protection Manager) by sending an email juanjose@eb-arq.com within 5 business days, and your request will be fulfilled.

Similarly, we wish to inform you that, as internal security measure, ESPIÑEIRA & BÁEZ ARQUITECTOS, S.A. DE C.V., records (on video) the entry of its staff and the general public into our facilities, retaining the footage for a period of one month.

Transfer

ESPIÑEIRA & BÁEZ ARQUITECTOS, S.A. DE C.V., in accordance with the provisions of Article 37, Section IV of the “Ley Federal de Protección de Datos Personales en Posesión de los Particulares”, will only transfer certain tax related information about you and the address of the construction site to contractors and suppliers for the purpose of fulfilling the contractual obligation that binds us to you

Should it be necessary to make any transfer other than that described in the preceding paragraph, your express consent Will be required.

Transfers made pursuant to Article 37, sections 1 through VII of the “Ley Federal de Protección de Datos Personales en Posesión de los Particulares” are exempt from the requirement for your consent.

Limitation on the Use and Disclosure of Personal Data

The processing of your personal data Will be limited to what is necessary and appropriate based on the legal relationship established with you, as well as for the purposes set forth in his Privacy Notice

Any client (data subject) or, where applicable, their legal representative, may exercise their Rights of Access, Rectification, Erasure an Objection, at any type; for this reason, ESPIÑEIRA & BÁEZ ARQUITECTOS, S.A. DE C.V., will provide the means to enable them to exercise these rights in a timely manner.

You may request to exercise these rights by submitting a simple written request or, if you prefer, by requesting the corresponding form, which can be provided by ARQ. JUAN JOSÉ ESPIÑEIRA CORTIZAS (Personal Data Protection Manager) at the address indicated in this Privacy Notice (Anatole France No. 26, Piso 1, Col. Polanco V Sección, Ciudad de México, C.P. 11560), where you must deliver it in person during business days and hours.

If you reside outside the Mexico City, you may submit your request via email to juanjose@eb-arq.com, addressed to al ARQ. JUAN JOSÉ ESPIÑEIRA CORTIZAS (Personal Data Protection Manager).

A response to such request will be provided within twenty (20) business days, counted from the date the respective request was received, If the request is granted, it will be carried out within fifteen (15) days following the date the response is communicated (via the method you specify).

 The aforementioned time limits may be extended once, for an equal period, provided that the circumstances of the case justify such an extension (pursuant to Article 32 of the “Ley Federal de Protección de Datos Personales en Posesión de los Particulares”).           

The obligation to provide access to the information shall be deemed fulfilled when the personal data is made available to the data subject or their legal representative; or, through the issuance of simple copies, electronic documents, or any other means that ESPIÑEIRA & BÁEZ ARQUITECTOS, S.A. DE C.V., provides to the data subject.

ESPIÑEIRA & BÁEZ ARQUITECTOS S.A. DE C.V., pursuant to Article 34 the “Ley Federal de Protección de Datos Personales en Posesión de los Particulares”, may deny access to personal data, its correctio, deletion, or objection, or the processing thereof, in the following cases:

When the requester is not the data subject or the legal representative is not duly authorized to act on their behalf;

When the applicant´s personal data is not found in its database;

When the rights of a third party would be infringed;

When there is a legal impediment or a ruling by a competent authority that restricts access to the personal data or does not permit its Correction, Deletion, or Objection;

When the Correction, Deletion, or Objection has already been carried out.

ESPIÑEIRA & BÁEZ ARQUITECTOS S.A. DE C.V. shall not be obligated to DELETE personal data when:

1. The data pertains to the parties to a private contract and is necessary for the performance and fulfillment of the contract;
2. It must be processed pursuant to a legal provision;
3. It would hinder judicial or administrative proceedings related to tax obligations, the investigation and prosecution of crimes, or the enforcement of administrative sanctions;
4. It is necessary to protect the data subject’s legally protected interests;
5. It is necessary to carry out an action in the public interest;
6. Are necessary to fulfill a legal obligation assumed by the data subject; or
7. Are processed for the purposes of medial prevention, diagnosis, or the management of health service; provided that such processing is carried out by a healthcare professional subject to a duty confidentiality.

Means to Revoke Consent

At any time, the client (Data Subject) has the right to request the REVOCATION of the consent granted to ESPIÑEIRA & BÁEZ ARQUITECTOS, S.A. DE C.V to process their personal data. The request will be processed within 5 days of receipt of the corresponding request, and the data subject will be notified in writing of the outcome of their request.
